Terms of Service
These terms govern your access to and use of the Orqana AI website, applications, and services. By creating an account or using Orqana AI, you agree to these terms.

1. Agreement to terms
Orqana AI, Inc. (“Orqana AI”, “we”, “us”) provides a platform for building and deploying AI agents. These Terms of Service form a binding agreement between you and Orqana AI. If you do not agree, do not use the service.

3. Accounts and security
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access. We may require multi-factor authentication for sensitive actions.
4. Acceptable use
You may not use Orqana AI to generate, store, or distribute content that is illegal, infringing, hateful, harassing, fraudulent, or that violates the rights of others. You may not attempt to bypass rate limits, probe for vulnerabilities, or resell access without written permission.
5. AI outputs
Orqana AI uses large language models and other AI services. Outputs may be inaccurate, incomplete, or inappropriate for your use case. You are responsible for reviewing outputs before using them in production, customer-facing, or regulated contexts. Do not rely on Orqana AI for legal, medical, or financial advice without human verification.
6. Fees and billing
Some features require a paid subscription or credits. Fees are non-refundable except where required by law. We may change pricing with reasonable notice. If you exceed usage limits, we may throttle or pause service until the next billing period or an upgrade.
7. Intellectual property
You retain ownership of your inputs and the agents you build. We retain ownership of the Orqana AI platform, brand, and underlying software. You grant us a limited license to host and process your content solely to provide the service.
8. Termination
You can delete your account at any time. We may suspend or terminate access for violations of these terms, non-payment, or if required by law. Upon termination, we will delete or anonymize your data in accordance with our Privacy Policy, subject to legal retention obligations.
9. Disclaimers and liability
The service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Changes to these terms
We may update these terms as the product evolves. Material changes will be posted here and, for account holders, notified by email. Continued use after changes means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws. Disputes will be resolved in the state or federal courts located in Delaware.
